Plain English interpretation of our contract

4.1 The payment is fixed for three years and cannot be reviewed until then. You must pay the upfront payment by Bac’s in advance of the terminal being dispatched and the monthly membership by dd.

4.2 The payments will be charged + VAT. Sorry we only collect it for the government.

4.3 The membership must be paid every month.

4.4 If a dd is not collected we will turn off the terminal immediately and chase for payment whilst it is turned off. (It might seem harsh; we are operating on very small margins and cannot afford to chase payments).

There may well be a good reason for this. If you are closing your business, please get the terminal back to us and there will be no further charges.

5.1 Once the Terminal has been delivered to you it is your responsibility.

5.2 You are responsible for installing the equipment. If you are having difficulty, please call us.

5.3 If you have paid for an install, make sure there is a plug and whatever other connections you need at the location where you want the terminal to be installed.

5.4 Please make sure that somebody is at the premises to receive the terminal at the allotted delivery time. Missed deliveries are charged by the courier.

6.1 Red Gorilla UK Ltd. Own the terminal, it is not yours.

6.2 Please look after it.

6.3 Please insure it.

6.4 If you break it, please tell us straight away, it is not the end of the world, and we will get another one out to you straightaway. The most that it will cost is £200.

7.1  a. It is a device for taking money please train your staff in its care and use.

     b. Clean it in line with recommended practice. (Don’t put it in the dishwasher or the sink)

     c. If you break the device the repairs are you responsibly. The average repair is £90.00

     d. Don’t try to dismantle the devise to repair. It has tamper alarms and will be rendered Useless.

         g. If Red Gorilla UK Ltd or the bank come to your premises let them examine the equipment.

      i.  Don’t sell it, it’s not yours.

      j. Don’t nail it down, at some point we’ll need to swap it out.

      k. Don’t let anyone else nail it down or make it unavailable to us

      l.  Do not surrender the equipment to anyone other than Red Gorilla.

      m.  Do not take fraudulent payments or use it to break a window.

8.1   The equipment will serve its purpose. If it stops working, we will remedy it by replacement if

a. You notify us within 10 days of the fault becoming apparent

b. We can examine the equipment. (You return it to us)

c. The problem is not caused by you, or you have had an unauthorized party attempt to repair the equipment

d. The defect is not caused by manufacturer or Red Gorilla

e. The cause is faulty equipment material or design.

9   This is a piece of equipment that is designed to take money. We cannot limit our liability in areas set out in 9.2. However, we cannot be held responsible in any circumstances for your losses, however you present them, if the terminal stops working whether it be a fault in the service, the equipment or the terminal is turned off remotely for any reason

10 and 11. Usually this section is a list of reasons why you cannot terminate this agreement.

You can cancel our agreement at any time. We merely ask that you notify us of your intention to cancel our service five days before the end of any month and return the terminal before the seventh day of the month after your contract ends.

So, if you tell us that you will not require a terminal from Jan 1st.

1. Tell us before close of business 26/12

2. Return the Terminal before close of business 07/01

What if It’s a day late? Let’s just say we are not going to fall out over a month’s membership.

Just return the terminal and all is good in the world and then we can start again at any point.

13. Whatever confidential information that we share of each other’s will be treated with the strictest of confidence.

14. You may not allow other business entities to take payments using this equipment. It is called Money Laundering and frowned upon.

15. Sometimes a representative of our company might overstep the mark and offer things that are not in the agreement. If you do not have it in an official document signed by both parties it is not a valid part of our contract.
